Well...Let me let her tell you the rest of the story.
Apparently Dick Black's daughter Michelle Black Staton attempted to tag my photos not realizing AS THE OWNER OF THE PHOTO I have to give MY PERMISSION. Which I DID NOT. So Dick Black's campaign simply downloaded it from Facebook and used it for their email WITHOUT MY AUTHORIZATION OR PERMISSION!! Great judgment call for an attorney to make. Copyright to your original work is inherent upon its being fixed in a tangible medium (which digital photographs most certainly are, under the law, I assure you). Most people even know, by now, that the once-ubiquitous "copyright notice" is no longer necessary (hasn't been for a long time, under something called "The Berne Convention").
ReplyDeleteNow, candidates rip off pictures of each other from their Web sites and mailers all the time. That's not allowed under copyright law either, but the unwritten rules of the game allow for it, probably on the theory that, if a candidate sued another candidate over it, the suing candidate would look thin-skinned and petty.
But... we do not swipe the work of third parties, especially professionals putting up photos on their own facebook pages, Web sites, etc. Last time I looked, statutory damages for deliberate infringement were set at $100,000. If Dick Black thinks the Shawn Mitchell campaign won't sue over this, Dick Black is right. That's because the Shawn Mitchell campaign doesn't own the copyright to Catherine Read's photos: Catherine Read does.
Don't know what she'll do, but it sure does tell you what Dick Black thinks of her rights.
